The Town of Newton has adopted the “International Property Maintenance Code” for regulating and governing the conditions and maintenance for all property, buildings and structures within the Town.

In an on-going effort to maintain the quality of life in the Town, Code Enforcement Officers respond to citizen’s complaints regarding observed and alleged violations of the Municipal Code.
                                     
The following is general information regarding what constitutes a violation:

  • Overgrown vegetation
  • Landscaping (not maintained)
  • Abandoned/Inoperable vehicles
  • Trash containers left in the public view
  • House exterior not maintained
  • Parking of vehicles
  • Home Businesses/Occupations without proper permits
  • Property not maintained

Property Maintenace Violation Appeal Application

Snow Shoveling
Snow and ice must be removed from sidewalks within 12 hours of daylight after snow has fallen and/or ice has formed. If removing ice is impracticable, sand, grit, or ice melting material must be down within 12 hours of daylight after the formation of ice.

If a building is occupied by more than one family or business unit, the tenant or occupant of the first floor shall be required to remove all snow and ice.

Any complaints regarding this matter should be referred to the Newton Police Department at (973) 383-2525.

Removal of Grass, Weeds, Brush and other Debris
The owner, occupant, tenant or person in possession of any land within the Town shall keep such land free of brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris, where removal of the same is necessary and expedient for the preservation of the public health, safety, general welfare and/or for the elimination of a fire hazard.

The owner, occupant, tenant or person in possession of any land within the Town that borders upon or abuts a public street in the Town shall keep that part of the street bordering or abutting said land free of brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris, where removal of the same is necessary and expedient for the preservation of the public health, safety, general welfare and/or for the elimination of a fire hazard.

Hydrants
The owner, occupant or tenant of premises abutting or bordering upon any street in the Town shall remove all snow and ice from the abutting sidewalks and fire hydrants of such street or, in the event of ice which may be so frozen as to make removal impracticable, shall cause the same to be thoroughly covered with sand, ice melting materials, or such other suitable grit, within 12 hours of daylight after the same shall fall or be formed thereon.

The owner, occupant or tenant of premises used by the public or business customers shall remove all snow and ice from sidewalks, fire hydrants, street, and parking areas used by the public in the transaction of business threat and, in the event of ice which may be so frozen as to make removal impracticable, shall cause the same to be thoroughly covered with sand, ice melting material, or suitable grit, within 12 hours of daylight after the same shall fall or be formed thereon. 

In case a building is occupied by more than one family or business unit, the tenant or occupant of the first floor shall be required to remove all snow and ice.

A certificate of compliance inspection and approval is required prior to the re-occupancy or continued occupancy by means of re-rental or re-sale of all one- and two-family residential dwellings or dwelling units, located in the Town of Newton.

Please download the Certificate of Compliance form by clicking the link below or pick up a copy at the Code Enforcement Department located on the ground floor of the Municipal Building, Monday through Friday 10:00am to 2:00pm.  Payment is required upon submission of this form.  All construction permits must be closed and there can be no open code enforcement violations in order for this process to proceed.  If you should have any questions, please contact the Code Enforcement Director at 973-383-3521 ext, 256.

Inspections are performed Monday - Friday after 4:00pm and any time on Saturday and Sunday.
